FWCJUA Workplace Safety
The FWCJUA shall provide all Policyholders through its Service Provider, Travelers, in conformance with generally accepted insurance industry practices and according to the specifications provided below: loss control, safety and industrial hygiene surveys, consultations, and related services.
Employers applying for or renewing coverage will be required to acknowledge that they will comply with the FWCJUA safety program. Subsequently, at policy issuance, the FWCJUA through its service provider, Travelers, shall notify the employer that participation in the safety program is mandatory and provide materials regarding the safety program including standardized, industry-specific safety and loss control practices to which the employer must comply. The employer will also be notified that failure to demonstrate substantial evidence of compliance or intent to comply with the safety program may result in disqualifying the employer from eligibility within either certain rating tiers or the FWCJUA, thereby resulting in the cancellation of the employer’s policy. Additionally, the FWCJUA shall begin issuing notices of cancellation if after sixty (60) calendar days, but no later than ninety (90) calendar days from submission of reasonable loss control recommendations the policyholder has failed to demonstrate substantial evidence of compliance or intent to comply therewith.

Safety Program Premium Credit/Drug-Free Workplace Premium Credit
An FWCJUA policy may be reduced by 2%, if the policyholder implements a certified Safety Program in accordance with the requirements of section 440.1025, Florida Statutes, and the Employer Safety Premium Credit Program rule in the FWCJUA Operations Manual. In addition, a policy may be reduced by 5%, if the policyholder implements and executes a certified drug free workplace program that meets the criteria established by the Agency for Health Care Administration.
A policyholder, with an average premium of $5,000, that implements a certified Safety Program may produce a premium savings of $100.00, and if that same policyholder implements a drug-free workplace program, the policyholder may generate an additional savings of $243.00, for a total premium savings of $343.00.
